This Privacy Policy applies to our website, https://beechvalley.com (“Site”), our applications, https://app.beechvalley.com and https://talent.beechvalley.com (together, the “App”), and the services available through the Site and App. It describes how Beech Valley Solutions LLC (“Beech Valley,” “we,” “us,” or “our”) collects, uses, and discloses personal information about applicants, consultants, clients, and visitors, and explains the choices individuals have regarding their personal information.

Beech Valley operates a platform that matches vetted consultants, primarily in accounting, finance, and IT, with clients for project-based engagements and direct-hire placements. From time to time we also place candidates in other professional roles. The Site and App are intended for use in the United States by individuals 18 years of age or older.

1. Information We Collect

Information you provide to us. What we collect depends on how you interact with us.

If you are an applicant or consultant, we collect the information you submit when you apply, create a profile, or work with our team, which may include: your name and contact information (email, phone, mailing address); your resume and the information it contains, such as employment history, education, certifications, and professional credentials (for example, CPA license information); skills assessment and test results; references; your rate and compensation preferences; and availability and engagement history. If you are placed on a project, we also collect information needed to engage and pay you, which may include tax forms (such as a Form W-9) and bank account information for payment.

If you are a client or a prospective client, we collect the business contact information you provide, such as your name, title, company, email, and phone number, along with information about your staffing needs, project requirements, and engagement and billing history.

If you are a visitor, we collect the information you submit through forms on the Site, such as a Contact Us form or a mailing list signup.

Information we collect automatically. When you use the Site or App, we and our service providers automatically collect certain information through cookies and similar technologies, including your IP address, browser and device information, operating system, pages viewed, session duration, and general geographic location. We use Google Analytics on the Site to understand how it is used and to improve it. In the App, we use an error monitoring service that may collect technical information, such as browser type and user ID, when an error occurs. See Section 5 for more on cookies and analytics.

Information we collect from third parties. If you are being considered for or placed on a project, we may receive information about you from references you provide and, as described in Section 4, from a third-party background check provider. We may also obtain professional information about applicants and consultants from other sources, such as professional networking sites, job boards, recruiting databases, referrals, and other publicly available professional sources. For clients and prospective clients, we may obtain business contact information from sources such as professional networking sites, referrals, industry events, and business information providers.

2. How We Use Personal Information

We use the information we collect to:

Operate the platform, including evaluating applications, vetting consultants, matching consultants and candidates with client engagements and positions, and administering engagements;
Engage and pay consultants, invoice clients, and maintain payment, tax, accounting, and other business records;
Communicate with you about your account, applications, projects, and inquiries, and provide support;
Send newsletters and marketing communications, which you may opt out of at any time as described in Section 6;
Analyze and improve the Site, App, and our services;
Protect our business, prevent and detect fraud and unauthorized access, and enforce our agreements, including our Terms of Service;
Comply with legal obligations, including responding to subpoenas, court orders, and other lawful requests; and
Create aggregated or de-identified information, which does not identify any individual, for research, analytics, and business purposes.

3. How We Share Personal Information

We do not sell or rent your personal information, and we do not share it with third parties for their own marketing purposes. If that ever changes, we will notify you first and give you the opportunity to opt in.

We share personal information in the following circumstances:

With clients. If you are a consultant, sharing your professional information with prospective clients is central to how our platform works. We share consultant profiles, resumes, credentials, assessment results, rate information, and related professional information with clients who are considering you for an engagement or position, and with clients you are placed with.

With service providers. We share personal information with vendors that perform services on our behalf, such as cloud hosting and data storage, resume parsing, applicant tracking, customer relationship management, authentication, payment processing, analytics, error monitoring, email delivery, online forms and surveys, spam prevention, artificial intelligence services, and background screening. These providers are permitted to use personal information only to provide services to us.

With professional advisers. We may share information with our lawyers, accountants, and similar advisers where needed.

Business transfers. We may disclose personal information as part of a merger, acquisition, financing, sale or transfer of assets, restructuring, or similar transaction, including related due diligence, where permitted by law.

Legal requirements and protection of rights. We may disclose personal information if required to do so by law, or where we believe it is necessary to respond to legal process, enforce our agreements, prevent fraud, or protect the rights, property, or safety of Beech Valley, our users, or others.

We may also share aggregated or de-identified information that does not identify any individual.

4. Background Checks

This section applies to consultants. Beech Valley does not conduct criminal background screenings at the time of application or as part of the vetting process. A background check, conducted by a third-party consumer reporting agency, may be required as a condition of a consultant’s placement on a client project or hire into a client position. Where such a check is required and conducted by or on behalf of Beech Valley, the consultant will receive a separate disclosure and authorization form in accordance with the Fair Credit Reporting Act before the check is performed. In some cases, a client may conduct its own background check in lieu of one conducted by Beech Valley, and any such check is governed by the client’s process and applicable law.

5. Cookies and Analytics

The Site and App use cookies and similar technologies. Some cookies are necessary for the Site and App to function, such as those that enable page navigation, login, and access to secure areas. The Site also uses cookies for analytics. The App does not use analytics or advertising cookies. We do not currently display a cookie consent banner or offer an on-site cookie opt-out tool; the choices available to you are those described below.

We use Google Analytics to collect information about Site usage, such as the number of users and sessions, session duration, device and browser information, and general geography. If you do not want Google Analytics to collect information about your visits, Google offers a browser add-on that blocks it, available at https://tools.google.com/dlpage/gaoptout.

The Site also includes content and resources from third parties, such as embedded YouTube videos and Google Fonts. These providers may receive your IP address and browser information, and YouTube may set its own cookies when you view an embedded video. Their use of that information is governed by their own privacy policies.

You can also manage or delete cookies through your browser settings. Disabling cookies may affect some functions of the Site or App. Browser settings apply only to the browser and device on which they are set.

Do Not Track. Some browsers transmit “Do Not Track” signals. Like most websites, our Site does not currently respond to these signals.

6. Your Choices and Rights

Marketing communications. You may opt out of marketing emails at any time by following the unsubscribe instructions in the email or by contacting us at contact@beechvalley.com. Even if you opt out of marketing, we may still send you transactional messages about your account, applications, or engagements.

Access, correction, and deletion. If you would like to review the personal information we hold about you, or request that we correct or delete it, contact us at privacy@beechvalley.com. We honor these requests from any user regardless of location, subject to information we are required to retain for legal, tax, accounting, contractual, or dispute-resolution purposes. We may take reasonable steps to verify your identity before fulfilling a request, and we may deny or limit a request where permitted or required by applicable law. Requests to delete your account may also be made as described in our Terms of Service.

7. Data Retention

We retain personal information for as long as needed for the purposes described in this Policy, which generally means for the duration of your relationship with Beech Valley and for a period afterward as required for legal, tax, accounting, record-keeping, and dispute-resolution purposes. Consultant profile information may be retained while you remain in our network so that we can consider you for future engagements. You may request deletion at any time as described in Section 6.

8. Security

We use administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee the security of your information.

9. Children’s Privacy

The Site and App are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided us personal information, contact us at privacy@beechvalley.com and we will delete it.

10. Third-Party Links and Websites

The Site may contain links to other websites whose information practices differ from ours. We do not control those websites, and this Policy does not apply to them. Please review the privacy notices of any third-party site you visit.

11. Changes to This Policy

We may revise this Policy from time to time. We will post the updated Policy on this page and update the revision date below. For material changes, we will provide notice in advance, such as by email to the address associated with your account or through a notice on the Site or App.
